Introduction

These GTC are applicable to

  • the use of the service and access to this application, and
  • any other related agreement or legal relationship with the provider

in a legally binding manner. Defined terms are listed in the relevant section of this document. 

Users are requested to take careful note of this document.

FLT Connect is a digital recruiting portal that brings companies and skilled workers together in a targeted manner. At www.flt-connect.com, the platform offers a user-friendly environment for publishing job advertisements, applicant management and the efficient matching process between employers and qualified applicants - with a particular focus on skilled workers in the trades, technology, logistics and industry.

The most important facts at a glance

  • It should be noted that individual provisions of these GTC may only be relevant for certain categories of users, for example only for consumers or only for users who are not acting as consumers. Such restrictions of the scope of application shall be expressly indicated in each clause concerned. If no such reference is made, the clause shall apply to all users.
  • This application automatically renews product subscriptions. Information on a) the renewal period, b) the termination and c) the termination letter can be found in the corresponding section of these GTC.

TERMS OF USE

Unless otherwise stated, the conditions listed in this section apply when accessing this application.

Individual or additional terms of use or access may apply in certain circumstances and in such cases are expressly stated in this document.

By using the service, users confirm that they fulfill the following conditions:

  • Users can be consumers or business customers;

Account creation

In order to use the service, users must register or create a user account by providing all required data or information completely and truthfully.
The service is only available to registered users.

The user must ensure that the access data is kept confidential and secure. For this reason, the user must also choose a password that meets the highest possible security requirements for this application.

When registering, users agree to be responsible for all actions taken in connection with their username and password.
Users are obliged to inform the Provider immediately and unequivocally using the contact details provided in this document if they believe that their personal information, including user accounts, access data or personal data, has been breached, unlawfully disclosed or stolen.

Termination of the user account

User accounts can be deleted at any time as follows:

  • By contacting the provider directly using the contact details provided in this document.

Blocking and deletion of the user account

The provider reserves the right to block or delete user accounts which it deems inappropriate or offensive or which, in its opinion, violate these GTC at its own discretion at any time and without prior notice.

The blocking or deletion of user accounts does not give rise to any claims for damages, indemnification or reimbursement on the part of the user.

The blocking or deletion of accounts for reasons for which the user is responsible does not release the user from the obligation to pay agreed fees or prices.

Content available via this application

Unless otherwise stated or clearly recognizable, all content available via this application is the property of the provider and is provided by the provider or its licensors.

The provider makes every effort to ensure that the content provided via this application does not violate applicable laws or the rights of third parties. However, it is not always possible to achieve this result.
In such cases, users are requested to address their complaint preferably to the contact details provided in this document. The right to enforce any claims (out of) court remains unaffected by this.

Rights to the content available via this application

All rights to the content are reserved by the provider.

Users may only use the content to the extent that this is necessary or - even implicitly - intended for the proper use of the service.

In particular, users are not permitted to reproduce, download, distribute beyond the limits defined below, edit, translate, modify, redesign, publish, transfer to third parties, sell or license the content, or enable third parties - even without the user's knowledge - to perform the aforementioned actions via their own device.

Where expressly indicated via this Application, the User may download, reproduce and/or distribute selected content available via this Application for exclusively personal and non-commercial purposes, provided that the copyright notices and any other notices required by the Provider are correctly affixed.

Legal restrictions or exceptions remain unaffected by this.

Content from users

Users have the option of uploading their own content to this application, sharing it via this application or making it available.

By uploading, sharing or providing their content as described, users assure that they are authorized to do so and that they are not violating any legal regulations or third-party rights.

Rights to user content

By uploading their own content to this application, users grant the provider a non-exclusive and free-of-charge right to use and process the content in order to operate and maintain this application as contractually intended.

To the extent permitted by law, users waive the exercise of any moral rights in connection with the content transmitted to this application.

Users acknowledge, accept and confirm that all content they make available through this Application is made available under the same general terms and conditions applicable to other content made available through this Application.

Liability for user content

Users are responsible for content that they upload to this application or publish, share or make available via this application. Users acknowledge and accept that the provider does not filter or moderate such content.

The provider therefore reserves the right to remove, delete or block such content at its own discretion and to deny the uploading user access to this application without prior notice:

  • if an (alleged) violation of these terms and conditions, the rights of third parties or applicable law based on such content becomes known;
  • if an infringement of exclusive property rights is reported;
  • if an indication of a violation of the personal rights of third parties, including the violation of their privacy, is received;
  • on the basis of an official order; or
  • if the provider is made aware that the availability of the content via this application may have a detrimental effect on users, third parties and/or the availability of the service.

The removal, deletion or blocking of content does not give rise to any claims for damages or reimbursement on the part of the user responsible for the content in question.

Users undertake to indemnify the provider against any claims and/or damages arising from or in connection with content that they make available via this application.

Access to external resources

Users may be able to access external resources provided by third parties through this Application. Users acknowledge and accept that the Provider has no control over such resources and is therefore not responsible for their content and availability.
The conditions under which such resources provided by third parties are available and under which rights of use to such content are granted, if applicable, result from the contractual provisions of each third party or, alternatively, from the applicable statutory provisions.

Permitted use

This application and the service may only be used as intended and in accordance with these GTC and the applicable statutory provisions.

Users are responsible for ensuring that their access to this application and/or their use of the service does not violate any legal provisions, regulations or third-party rights.

Therefore, the provider reserves the right to take all appropriate measures to protect its legitimate interests, such as denying users access to this application or the service, terminating contracts, reporting to the competent authorities - such as judicial or administrative authorities - any objectionable actions taking place via this application or the service, if users are proven or suspected to have done so:

  • violate statutory provisions, regulations or these GTC; or
  • infringe the rights of third parties; or
  • significantly impair the legitimate interests of the provider; or
  • insult the provider or a third party.

 

CONDITIONS OF SALE

Chargeable products

Some of the products available via this application as part of the service are subject to a charge.

Prices, terms and other conditions applicable to the purchase of such products are described below. In all other respects, reference is made to this application and to the sections provided for this purpose.

Product description

Prices, descriptions and availability of the products can be viewed in the relevant areas via this application and are subject to change without notice.

Although products are presented via this application with the greatest possible technical care, representations of any kind (including graphical representations, images, colors, sounds) are for reference only and do not constitute a warranty as to the characteristics of the product purchased.

The features of the selected product will be explained during the purchase process.

Purchase process

All steps from selecting a product to placing an order are part of the purchase process.

The purchase process includes the following steps:

  • The user selects the desired product from the range and checks their own product selection.
  • After checking the details of the product selection, the user can place the order by sending it to the provider.

Placing the order

When the user places an order, the following applies:

  • The contract is concluded when the order is placed. Placing an order therefore creates an obligation for the user to pay the purchase price, taxes and any other fees and expenses as specified on the order page.
  • If information is required from the user, such as personal information or data, specifications or special requests, the placing of the order constitutes an obligation on the part of the user to cooperate accordingly.
  • After placing the order, users receive a confirmation of receipt.

All notifications in connection with the described purchase process will be sent to the e-mail address provided by the user for this purpose.

Prices

Users will be informed of all fees, taxes and costs (including any shipping costs) to be borne by them during the purchase process and before placing the order.

The prices are displayed via this application as follows:

  • either excluding or including all applicable fees, taxes and costs, depending on which section the user is currently in.

Payment methods

Information on the accepted payment methods will be provided during the purchase process.

Some payment methods may only be available subject to additional conditions or fees. In these cases, you will find the relevant information in the corresponding section of the service (this application).

All payments are processed via third-party providers. Therefore, this application does not collect any payment information - such as credit card details - but only receives a notification when the payment has been successfully completed. The user can read the privacy policy of this application to learn more about the data processing and his rights in relation to his data.

If the payment via the available methods fails or is rejected by the payment service provider, the provider is not obliged to fulfill the order. If a payment fails or is rejected, the provider reserves the right to claim all associated costs or compensation from the user.

Maintenance of the rights of use

Users do not acquire any rights of use to the purchased product until the provider has received full payment of the purchase price.

Contractual right of withdrawal

The provider or seller grants users a contractual right to withdraw from the contract under the conditions described in the respective section on this application within 15 days of the conclusion of the contract.

Delivery

Provision of services

The purchased service must be provided or made available within the period specified via this application, or as notified prior to the order being placed.

Contract term

Subscriptions

Subscriptions allow users to receive a product continuously or regularly over a certain period of time. Details on the type of subscription and cancellation are listed below.

Subscriptions with a fixed term

Paid subscriptions with a fixed term begin on the day payment is received by the provider and have the term selected by the user or specified when the order is placed.

After the subscription period has expired, the product is no longer accessible.

Automatic renewal of subscriptions with a fixed term

At the end of the initial term, the subscription is automatically renewed for an unlimited period unless the user cancels at least 30 days before the end of this term.

The fee due upon renewal will be charged via the payment method selected by the user at the time of purchase.

After renewal, the subscription runs indefinitely and can be canceled monthly.

Termination

Renewed subscriptions can be terminated at any time by sending a clear and unambiguous notice of termination to the provider. To do so, users must use the contact details provided in this document or - if possible - the corresponding control elements made available via this application.

If the letter of termination is received by the provider by the end of the current month, the subscription expires at the end of that month.

Provision of personal data

In order to access or receive some of the products provided within this service through this Application, Users may be required to provide their Personal Data as specified on this Application.

User rights

Right of withdrawal

Provided there are no exceptions, the user can withdraw from the contract within the period specified below (usually 14 days) without giving reasons. In this section, users can find out more about the withdrawal conditions.

The right of withdrawal does not apply to this application.

Users acknowledge and accept that, due to the nature of the offer, the right of withdrawal does not apply to contracts concluded via this application.

User rights in the United Kingdom

Right of withdrawal

Unless exceptions apply, users who are consumers in the UK have a statutory right of withdrawal under UK law and may withdraw from contracts concluded online (distance contracts) within the period specified below (usually 14 days) without giving any reason.

Users who are not considered consumers cannot benefit from the rights described in this section. Users can find out about the withdrawal conditions in this section.

The right of withdrawal does not apply to this application

Users acknowledge and accept that the right of withdrawal does not apply to contracts concluded via this application due to the nature of the offer.

 

Legal guarantee of conformity for digital products under EU law

Under EU law, traders guarantee the conformity of the digital products they make available to consumers for a period of at least 2 years from delivery or, in the case of digital products supplied continuously for a period of more than 2 years, for the entire period of supply.

If users are considered European consumers, the legal guarantee of conformity applies to the digital products available on this application in accordance with the laws of the country in which they have their habitual residence.

The national laws of such a country may grant users further rights.

 

Liability and indemnification

Unless expressly stated otherwise or agreed with the users, the provider's liability for damages in connection with the performance of the contract is excluded, limited and/or restricted to the extent permitted by applicable law.

Indemnification

To the extent permitted by applicable law, the User agrees to indemnify and hold the Provider and its subsidiaries, affiliates, officers, directors, agents, co-branders, partners and employees harmless from any claim or demand, including, but not limited to, attorneys' fees and costs, made by any third party due to or arising out of or in connection with any culpable violation of these TOS by the User or its agents, officers, directors, representatives, co-branders, partners and employees, which are asserted on the basis of or in connection with a culpable violation of these GTC, third-party rights or statutory provisions in connection with the use of the Service by the User or its agents, officers, directors, representatives, co-branders, partners and employees.

The aforementioned also applies to all claims asserted by third parties (including, but not limited to, the Owner's clients or customers) against the Owner in connection with the digital products provided by the User, such as claims for defects.

Limitation of liability

Unless expressly stated otherwise and without prejudice to the applicable statutory provisions, users have no right to claim damages from the provider (or any natural or legal person acting on its behalf).

This does not apply to damages to life, health or physical integrity or damages due to the breach of essential contractual obligations, such as an obligation absolutely necessary to achieve the purpose of the contract and/or damages due to intent or gross negligence, provided that this application has been used properly and correctly by the user.

Unless damages were caused intentionally or by gross negligence or affect life, health or physical integrity, the provider is only liable for the amount of damages typical and foreseeable at the time of conclusion of the contract.

Users in Australia

Limitation of liability

Warranty rights, conditions, guarantees, rights and remedies to which users are entitled under the Competition and Consumer Act 2010 (Cth) are not affected in any way by the provisions of these GTC. The same applies to any similar mandatory national or territorial laws that confer inalienable rights on users. To the extent permitted by law, our liability to users - including liability for breach of an unwaivable right and any other liability not excluded by these T&Cs - shall be limited, at the provider's reasonable discretion, to subsequent performance or reimbursement of the costs incurred for the renewed provision of the services.

Users in the USA

Warranty exclusion

This application is provided and made available exclusively "as is" and "as available". Use of the service is at your own risk. The provider expressly disclaims all conditions, representations and warranties, whether express, implied, statutory or otherwise, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement to the extent permitted by law. Any advice or information, whether oral or written, obtained by the User from the Provider or through the Service shall not create any warranties unless expressly stated.

Notwithstanding the foregoing, Provider, its subsidiaries, affiliates, licensors, officers, directors, agents, co-branders, partners, suppliers and employees do not warrant that the Content will be reliable, accurate or correct; that the Service will meet users' expectations; that the Service will be uninterrupted or reliably available at any particular time or location; that any defects or errors will be corrected; or that the Service is free of viruses or other harmful components. Any content downloaded or otherwise obtained through the use of the Service is downloaded at your own risk. Users are solely responsible for any damage to the User's computer system or mobile device or loss of data that results from such download or use of the Service by the User.

The Provider does not warrant or assume any responsibility for any products or services advertised or offered by third parties through the Service or any hyperlinked website or service, nor does it endorse such products or services. Transactions between users and third party providers of products or services are neither brokered nor monitored by the Provider.

The service may become inaccessible or not function properly with the user's web browser, mobile device and/or operating system. The provider cannot be held liable for any perceived or actual damage resulting from the content, operation or use of this service.

Federal law, some states and other jurisdictions do not allow the exclusion or limitation of certain warranties. The above exclusions may not apply to Users. This Agreement gives you specific legal rights, and you may also have other rights which vary from jurisdiction to jurisdiction. The exclusions and limitations of liability under the Agreement are void where prohibited by applicable law.

Limitation of liability

  • To the extent permitted by law, in no event shall the Provider and its subsidiaries, affiliates, officers, directors, agents, co-branders, partners, suppliers and employees be liable for
  • any indirect, punitive, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising in connection with the Service or its unavailability; and
  • any damage or loss resulting from hacking, tampering or other unauthorized access to or use of the Service or the User Account and the information contained therein;
  • any errors, mistakes or inaccuracies in the content;
  • personal injury or property damage of any kind arising from access to or use of the service by the user;
  • any unauthorized access to the provider's backup servers and/or the personal information stored therein;
  • any interruption or cessation of transmission to or through the Service;
  • any bugs, viruses, Trojans or similar that may be transmitted to or through the Service;
  • any errors or omissions in the Content or for any loss or damage arising from the use of any Content posted, emailed, transmitted or otherwise made available via the Service; and/or
  • the defamatory, offensive or illegal behavior of a user or a third party.

Any liability of the Provider, its subsidiaries, affiliates, officers, directors, agents, co-branders, partners, suppliers and employees for any claims, revenues, liabilities, obligations, damages, losses or costs shall be limited to the amount paid under this Agreement by the User to the Provider in the preceding 12 months or, if less, over the entire term of this Agreement between the Provider and the User.

This limitation of liability applies to the maximum extent permitted by applicable law, regardless of whether the alleged liability is based on contract, tort, negligence, strict liability or any other basis, even if the user has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. These T&Cs confer certain rights on the user, while the user may have other rights depending on the jurisdiction. The exclusions and limitations of liability under the T&Cs are void where prohibited by applicable law.

Indemnification

The User agrees to indemnify and hold the Provider and its subsidiaries, affiliates, officers, directors, agents, co-branders, partners, suppliers and employees harmless from and against any and all claims or demands, damages, obligations, losses, liabilities, costs or debts and expenses, including, but not limited to, legal fees and expenses, arising from

  • access to and use of the Service by the User, including any data or content transmitted or received by the User;
  • the breach of these GTC by the User, including but not limited to the breach by the User of any of the representations and warranties contained in these GTC;
  • the infringement of third-party rights by the user, including but not limited to personal rights or intellectual property rights;
  • the violation of statutory provisions, rules or regulations by the user;
  • any content transmitted from the user account, including in the case of access by third parties using the user's username, password or other security measures, if any, and including misleading, false or inaccurate information;
  • the alleged misconduct of the user; or
  • the breach of any legal provision by the User or its affiliates, officers, directors, agents, co-branders, partners, suppliers and employees, to the extent permitted by applicable law.

Common provisions

No waiver

Failure by the Provider to assert any right under these GTC or to enforce any provision of these GTC shall not constitute a waiver of such right or provision. No waiver shall be deemed a further or continuing waiver.

Service interruption

In order to ensure the best possible service, the provider reserves the right to interrupt the service for maintenance, system updates or other changes. The provider will inform users accordingly.

The Provider may also suspend or terminate the Service entirely within the framework of the statutory provisions. In the event of termination of the service, the provider will give users the opportunity to secure personal data or information in accordance with applicable law and will take into account any claims of users for further use and/or damages under applicable law.

In addition, the service may be unavailable for reasons beyond the control of the provider (so-called "force majeure" reasons) (e.g. infrastructure failures or power failures, etc.).

Resale

Users may not reproduce, duplicate, copy, sell, resell or exploit this Application and the Service in any way without the express prior written permission of the Provider, granted either directly or through a legitimate reseller program.

Privacy policy

To find out more about the use of their personal data, users can consult the privacy policy of the service (this application).

Intellectual property rights

Without prejudice to more specific provisions of these GTC, all intellectual property rights, such as copyrights, trademark rights, patent rights and design rights in connection with the Service (this Application) are the exclusive property of the Provider or its licensors and are subject to the protection of applicable law or international treaties relating to intellectual property.

All trademarks, trade names or figurative marks - and all other trademarks, trade names, service marks, word marks, illustrations, images or logos - appearing in connection with the Service (this Application) are and shall remain the exclusive property of the Provider or its licensors and are subject to protection under applicable law or international treaties relating to intellectual property.

Changes to these GTC 

The provider reserves the right to change or otherwise modify these GTC at any time. In this case, the provider will inform the user appropriately about these changes.

Such changes shall only apply to the contractual relationship from the date communicated to the user.

By continuing to use the service, the user accepts the amended GTC. If users do not wish to be bound by the changes, they must stop using the service and can terminate the contract.

If the revised terms and conditions are not accepted, either party may terminate the contract. For the relationship prior to the acceptance of the changes by the User, the respective valid previous version of the GTC shall apply. The User may obtain any previous version of the GTC from the Provider.

If required by law, the provider will inform the users in advance when the changed conditions come into effect.

Assignment

The Provider reserves the right to transfer, assign, replace by novation or pass on all rights and obligations arising from these GTC, taking into account the legitimate interests of the User.
The provisions on amendments to the GTC shall apply accordingly.

Users may not assign or transfer their rights or obligations under the GTC in any way without the written consent of the Provider.

All communications relating to the use of the service (this application) must be sent to the contact details provided in this document.

Severability clause 

Should any provision of these GTC be or become invalid or unenforceable under applicable law, this shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

US users

Any such invalid or unenforceable provisions shall be interpreted and modified to the extent necessary to make them valid, enforceable and consistent with their original intent. These Terms constitute the entire agreement between Users and the Provider relating to the subject matter hereof and supersede all other communications between the parties relating to the same subject matter, including any prior agreements.
These GTC shall be enforced to the extent permitted by law.

EU users

If any provision of these GTC is or is deemed to be invalid or unenforceable, the parties shall use their best endeavors to reach an amicable agreement on valid and enforceable provisions to replace the invalid, unenforceable or ineffective parts.
Otherwise, the ineffective, invalid or unenforceable provisions shall be replaced by the applicable statutory provisions, insofar as this is permissible or provided for under the applicable law.

Notwithstanding the foregoing, the nullity, invalidity or unenforceability of individual provisions of these GTC shall not render the entire agreement null and void, unless the provisions in question are essential to the contract or of such importance that the parties would not have concluded the contract if they had known of the invalidity of the provision. If the remaining provisions would lead to unreasonable hardship for one of the parties, the invalidity of the individual provision shall result in the invalidity of the entire agreement.

Applicable law

These GTC are subject to the law of the place where the provider has its registered office, with the exception of conflict of laws provisions. Users can find the location of the registered office in the relevant section of this document.

Primacy of national law

However, if the law of the country in which the user is located provides for a higher standard of consumer protection, that higher standard shall apply.

Exception for consumers in Switzerland

If the user is to be classified as a consumer in Switzerland, Swiss law applies.

Place of jurisdiction

The courts of the place in which the provider has its registered office - as indicated in this document - shall have exclusive jurisdiction for all disputes arising from or in connection with these GTC.

Exception for European consumers

This does not apply to users acting as European consumers or to users in the United Kingdom, Switzerland, Norway or Iceland acting as consumers.

 

Dispute resolution

Amicable dispute resolution

Users can contact the provider with any disputes, who will attempt to resolve them amicably.

The user's right to take legal action remains unaffected at all times. However, in the event of disputes regarding the use of the service (this application) or the service, the user is requested to contact the provider using the contact details provided in this document.

The User may send the complaint, including a brief description and, if applicable, the details of the related order, purchase or account, to the e-mail address of the Provider indicated in this document.

The provider will process the request immediately within 2 days of receipt.

Online dispute resolution for consumers

The European Commission has set up an online platform for alternative dispute resolution, which offers an out-of-court procedure for resolving disputes in connection with online contracts with consumers.

As a result, consumers in the EU, Norway, Iceland or Liechtenstein can use this platform to resolve disputes arising from contracts concluded online. The platform is accessible under the following link.

Please note that no new complaints can be submitted via the platform from March 20, 2025. However, you can continue to use the platform until July 19, 2025, provided that the complaints were submitted by March 20, 2025. The platform will be discontinued from July 20, 2025, after the EU Regulation 2024/3228 has been adopted.

 

Definitions and legal information 

This application (or this application)

The application through which the provision of the service is enabled.

Agreement

Any legally binding or contractual relationship between provider and user governed by these GTC.

Brazilian (or Brazil)

Applies to users who are in Brazil, regardless of their nationality.

Business users

Any user who is not acting as a consumer.

Digital product

is a product that consists of the following:

  • content that is created and provided in digital form; and/or
  • a service that enables the creation, processing, storage or access to data in digital form or enables the sharing or any interaction with digital data uploaded or created by the user or by another user of this application.

European (or Europe)

Applies to users who reside in the EU, regardless of their nationality.

Provider (or We)

Is the natural person(s) or legal entity(ies) that makes this Application and/or Service available to Users.

Product

A good or service offered through this Application, such as physical goods, digital files, software, booking services, etc., as well as any other types of products separately defined herein, such as digital products.
